Terms of service

The rules for using the service

Short, in plain English. Using ParHard on the web or in the app means you agree to these terms and to our privacy policy.

The short version

  • Be 13 or older, be one real person, and keep your scores honest.
  • You own what you post. You let us show it the way you chose.
  • Games are points only. No money, ever.
  • We do not offer a handicap. Strokes are whatever you and your group agree on.
  • Course info is checked with care but can be wrong. Confirm with the course before you drive.
  • Free stays free. Paid plans renew until you cancel, and store purchases are refunded by the store.

Who we are

ParHard is a working name for a product of The Schoeller Group LLC. "We" and "us" in these terms means The Schoeller Group LLC. The service is the website at parhard.com, the apps, the invitee web links and the public API.

Your account

  • You must be 13 or older. Some features have a higher age, which is said where it applies.
  • You sign in with Google or Apple. One account per person. Keep your sign-in method secure; what happens under your account is on you.
  • Give us a real name or one your group knows you by. Do not impersonate anyone.
  • Invitees do not need an account. If you open an outing link and enter a name, these terms apply to what you do from that link, and nothing more is asked of you.
  • Players under 18 have stricter sharing defaults, which are described in the privacy policy.

Acceptable use

Do not:

  • Harass, threaten or abuse anyone, in a crew, an outing thread, a message or a comment.
  • Enter a false score for another player, or alter the group's card to change a result.
  • Post anything hateful, sexual, violent, or that reveals someone's private information.
  • Pretend to be someone else, or run more than one account to get around a block, a limit or a suspension.
  • Scrape, crawl, copy or bulk download the site, the app or the API, other than through the public API under its own terms.
  • Probe, overload or interfere with the service, or try to reach data that is not yours.
  • Use the service for any form of wagering, or to collect or settle money for a game.
  • Post reviews you were paid for, reviews of a course you work for or own, or reviews of a round you did not play.

We may remove content, limit features or close an account that breaks these rules. See Termination below.

Your content

Your content is the scores, names, messages, reviews, photos and videos you add. You own it. So that the service can work, you give us a non-exclusive, worldwide, royalty-free license to host, store, copy, resize, transcode, display and share it inside the service, in the ways you chose: only you, your crew or outing, or public.

  • For items you make public, the license also covers showing them on the course page, in the app, and in share cards you make.
  • The license does not cover featuring your content in marketing, in the public API or in open downloads. Each of those needs a separate yes from you, per item.
  • Your content is never used to train an AI model. Any AI use of your private data needs your opt-in per feature, as the privacy policy describes.
  • The license ends when you delete the item, except for copies other people already shared outside the service, and backups until they expire.
  • You promise that you have the right to post what you post, and that people shown in a photo are fine with it. Do not post photos of children unless you are the parent.
  • Public items carry a report link. Anyone shown in a public photo can ask for it to come down, with or without an account.

Copyright: if you believe content on the service infringes your copyright, email support@parhard.com with the item, your rights and your contact details. We take down infringing content and close the accounts of repeat infringers.

Games are points only

Side games in ParHard (skins, match play, Stableford and the rest) are scored in points. We never hold, move, request or settle money for any game, and nothing in the service is a bet, a stake or a payout. If your group plays for anything outside the app, that is between you and is not part of the service. Do not use crew chat, outing threads or messages to collect money for a game.

No handicaps

ParHard does not calculate or display a golf handicap and is not affiliated with any handicap system. Strokes given or received in a game are entered by the player or the organizer. Nothing in the service is an official index or rating.

Course info and maps

  • Every course fact shows its source and the date we last checked it. We do not guess; unknown facts are left blank.
  • Facts change. Hours, fees, policies and conditions can be out of date. Confirm with the course before you book or drive.
  • Distances are shown in whole yards from the GPS in your phone or watch. They are an aid, not a measurement. Phones are not rangefinders, and signal, terrain and map data all add error.
  • Weather and alerts come from the National Weather Service. Use your own judgment about lightning and conditions. We cannot see the sky where you are.
  • Course data on this site is for personal use. Bulk access is through the public API under its own terms.

Plans and payment

  • Free is free forever: every course page, the map, weather, solo play, group scoring, joining any crew or outing, and one crew of your own.
  • Plus is for your own game. Crew is for the organizer, and the members of their crews get crew features at no cost.
  • Plans renew automatically until you cancel. On the web you buy through Stripe and manage or cancel at /me/billing. In the app you buy through the App Store or Google Play and manage or cancel in the store.
  • Cancelling stops the next charge. Your plan stays active until the end of the period you paid for.
  • Refunds for App Store and Google Play purchases are handled by Apple and Google under their rules; we cannot issue them. For a web purchase, email us within 14 days and we will refund it.
  • Prices can change. We give notice before a change applies to a renewal.
  • One account, one set of entitlements, everywhere. A plan bought on the web works in the app and the other way round.

Gear listings, when they open

A classifieds marketplace for used golf gear is planned. When it opens, these rules apply to it:

  • You must be 18 or older with a verified phone number. Personal gear only; no shops or resellers.
  • We do not handle payment. Buyers and sellers agree a price and pay each other outside the service. Meet in a public place in daylight, look before you pay, and never pay a deposit to hold an item.
  • Listings must describe a real physical item with your own photos. Counterfeit, stolen or prohibited items are removed and the account closed.
  • Listings are never a way to move money for a game. A listing that references a bet, a game or a debt is refused.
  • Listings expire after 60 days unless renewed. We may cap active listings per account.

Reporting and moderation

You can report any profile, item, comment, message or listing from where you see it, and block anyone. We review reports and remove content that breaks these terms, applying the same rules to good and bad reviews alike. We never remove a review for its rating or tone. The author is told which rule applied and can appeal once. We may suspend messaging or an account for repeat violations.

Termination

  • You can delete your account at any time in the app or at /account. The privacy policy says what is removed and what stays.
  • We can suspend or close an account that breaks these terms, puts other players at risk, or is used for fraud. Where we can, we will say why and give you a chance to answer.
  • If we close your account for a violation, a paid period already used is not refunded.
  • Sections about your content, points-only games, disclaimers, liability and governing law survive the end of your account.

Disclaimers and liability

Golf happens outdoors. You are responsible for your own safety and decisions on the course, including weather, carts and terrain. The service is provided as is, without warranties of any kind. Course facts, distances, weather and standings can be wrong or unavailable. To the extent the law allows, The Schoeller Group LLC is not liable for indirect or consequential damages, and our total liability to you is limited to what you paid us in the 12 months before the claim, or 100 dollars if you paid nothing. Some states do not allow these limits, so they may not apply to you.

Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute that cannot be settled by talking to us goes to the state or federal courts in Florida, and you agree to their jurisdiction. If you live somewhere whose law gives you rights that cannot be waived, those rights still apply.

Changes to these terms

When these terms change, the date at the top changes. If a change limits your rights or adds an obligation, we will tell you in the app or by email at least 14 days before it takes effect. Continuing to use the service after that means you accept the new terms.
